Unjustified Enrichment
A comparative study of the law of restitution

Edited by mr. P.W.L. Russell. VU university Press. Amsterdam, 1996. 95 pages.

The subject of unjustified enrichment is generating enormous interest inside and outside the Netherlands. In 1992, the new Burgerlijk Wetboek (Dutch Civil Code) introduced an important change: 'He who is unjustly enriched at the expense of another party, is obliged, as far as is reasonable, to pay compensation for the loss of the other party'. This article has far-reaching effects on Dutch jurisdiction. However, in Great Britain, France and Germany the subject also received much attention.

The book is composed of the following four articles written by specialists on the subject, presenting developments in German, Dutch and English enrichment law:

  • 'Restitution in the New Dutch Civil Code' by E.J.H. Schrage;
  • 'Recent developments in the English law of restitution' by G. Jones;
  • 'Neuere Entwicklungen im Bereicherungsrecht des Bürgerlichen Gesetzbuchs von 1900' by H.J. Wieling;
  • 'Modern developments in the French law of unjustified enrichment' by J.K.B.M.  Nicholas.
