A comparative study of the law of restitution
The subject of unjustified enrichment is generating enormous interest inside and outside the Netherlands. In 1992, the new Burgerlijk Wetboek (Dutch Civil Code) introduced an important change: 'He who is unjustly enriched at the expense of another party, is obliged, as far as is reasonable, to pay compensation for the loss of the other party'. This article has far-reaching effects on Dutch jurisdiction. However, in Great Britain, France and Germany the subject also received much attention.
